Trucking company sued after wreck with Texas driver

Big rigs are a common sight on Texas highways and roads. Unfortunately, due to the size and weight of semi-trucks, collisions with them can be catastrophic. That is why it is so important that truck drivers and trucking companies follow safety rules and regulations.

In cases where a trucking accident is caused by the negligent or wrongful acts of another party, such as the driver or the driver's employer, it may be possible for the injured victim to pursue compensation for the damages he or she has suffered in a personal injury lawsuit.

This is what a Texas woman has begun doing in the Eastern District of Texas, Lufkin Division. The woman alleges that a truck driver employed by an Indiana trucking company failed to yield the right of way, ran through a red light and collided into her vehicle causing her severe injuries.

The woman brought suit against the trucking company and the driver, seeking more than $75,000 in damages. According to a report, the accident occurred on Feb. 25, 2010 in Timpson, Texas, when the truck driver failed to yield and collided into her vehicle as she crossed Highway 59.

The woman claims to have injured her neck, back, head and left side in the accident. Her lawsuit accuses the truck driver of negligence for causing the accident and her subsequent injuries.

The truck driver's employer was also named in the lawsuit because of the legal doctrine of respondeat superior. This doctrine provides that an employer can be held liable for the negligent actions of its employees so long as the actions were performed within the scope of employment.
