Widow files suit following Texas City industrial accident

Last week, we wrote about the tragic industrial accident that claimed the life of a 26-year-old worker at the Port of Texas City. Since then, an investigation has been launched by the Occupational Safety and Health Administration and the widow of the worker has filed a wrongful death lawsuit.

So far, what is known about the industrial accident is that it occurred around 10 p.m. on Feb. 11 when the worker fell or became entangled in mechanical equipment at a plant owned by the Dallas Group of America. Investigators reported that the worker may have been exposed to dangerous fumes or gases before the accident.

The Dallas Group is the nation's only manufacturer of ammonium chloride. This is a dangerous substance that can cause drowsiness, mental confusion, tremors and comas if a person is exposed to or ingests large quantities.

Reportedly, the worker's widow is suing the Dallas Group and Action Personnel Group Inc. in a wrongful death lawsuit alleging that an unsafe work environment caused the death of her late husband. The lawsuit blames the defendants for failing to properly train workers in addition to other negligent behavior.

With the help of a personal injury attorney, the widow obtained a temporary restraining order that prevents the companies from altering or destroying the scene of the accident. Evidence will likely be gathered at the scene to use in the lawsuit.

Sadly, the worker's family suffered another blow just two years ago when the deceased worker's brother was killed in a work-related accident at a plant near Baytown. This family knows too well how dangerous industrial jobs can be, especially if employers don't put safety first.
