Texas electrician sues following accident at plant

Following workplace accidents in Texas, injured workers may be entitled to workers' compensation benefits or compensation from a personal injury lawsuit depending on the circumstances of the case. If negligence on behalf of an employer or a third party was involved, injured workers have two years from the date of the incident to file a lawsuit.

A Texas worker who was injured in the La Porte chemical plant fire last week decided not to waste any time filing his claim against the plant where he was burned. The worker was a contract electrician and says he "suffered severe chemical burns to his face as a result of the defendant's negligence."

Named as defendants in the lawsuit are Akzo Nobel Polymer Chemicals and the plant manager. The lawsuit states that the accident occurred on March 4 when the contract electrician was working on a plant actuator that "was corroded and in disrepair." The lawsuits states that at some point, the "the actuator broke and ejected a chemical" into the worker's face.

As black plumes of smoke spewed into the sky above the plant, the electrician was helped to a safety showed and then taken to an on-site clinic where personnel tried to wash the chemicals off of the worker's face. Eventually, the worker had to be taken to a local hospital for treatment.

The lawsuit accuses the defendants of failing to provide a "reasonably safe work environment" by not properly maintaining equipment on the premises.

This isn't the first time the La Porte chemical plant has faced personal injury lawsuits filed by injured workers. Following a plant fire and subsequent explosions in 2006, the plant was sued by two workers who said they suffered "severe burns" as a result of the "tragic and wholly unnecessary disaster."
