Tracy Morgan cleared for home rehab 1 month after truck accident

A month after the semi-truck accident that seriously injured Tracy Morgan, the actor has been cleared to go home to continue his rehabilitation. In one of our previous posts, we discussed how the crash raised questions about the safety of truck drivers' hours of service regulations.

The driver of the Wal-Mart truck that hit Morgan's limousine van is facing criminal charges, and now Morgan and two other injured van occupants have brought a lawsuit against Wal-Mart. The civil complaint claims that Wal-Mart was negligent in having the driver make a 700-mile commute from Georgia to Delaware. As we discussed before, the driver had allegedly been awake for more than 24 hours.

Morgan's attorneys announced their intention to take the civil claim against Wal-Mart to a jury trial in pursuit of compensatory and punitive damages. One of the injured van occupants' wives is also named as a plaintiff in the lawsuit, though she was not in the van at the time of the crash. Her claim relates to a "loss of services" resulting from the accident.

Comedian James McNair -- popularly known as Jimmy Mack -- was killed in the crash, and it remains to be seen what civil legal action his surviving loved ones may take.
