Some things you should know about oil rig injuries in TX and LA

Now let's discuss a related matter: oil rig accidents. Like workers on commercial boats, oil rig workers are afforded protections under the Jones Act. The law allows injured maritime workers, including employees on floating oil rigs and jack-ups, to sue their employers for negligence.

An employer might claim to have been unaware of dangerous conditions on an oil rig or boat, but that doesn't mean an injured worker can't sue and seek compensation. The fact that an oil rig is unreasonably dangerous is grounds to hold an employer liable for damages resulting from the unsafe conditions.

Injured oil rig workers may seek compensation for injuries resulting from malfunctioning pipe tongs, cable breaks, improperly placed catheads, slip and falls, grating collapses and more. Employers also have an obligation to ensure that workers are properly trained, and a co-worker's negligent operation of equipment could factor into a negligence claim against the employer or against the third-party worker.

For injurious work accidents that happen on fixed oil platforms, the law is different. Under the Outer Continental Shelf Lands Act, a fixed oil platform is regarded as an island of the nearest state. The nearest state's workers' compensation program should then cover a work injury suffered on a fixed platform.
