2 workers suffer burn injuries in another Texas torch accident

Serious accidents can happen when welders are told that a container they're using a torch on is empty when it really isn't. In industries throughout Texas, tanks and barrels contain flammable and potentially explosive substances, and proper precautions have to be taken before workers are asked to use a torch on these containers.

Things to know about the trial process for work-related injury claims

Depending on the circumstances of the accident, a work-related injury could lead to a workers' compensation claim or a negligence claim. The Shelton Law Firm represents injured workers in Texas and Louisiana. In Texas, the statute of limitations for a negligence claim is two years, and in Louisiana, the time limit is one year.

How does workplace negligence factor into Texas injury claims?

If your work-related injury is covered by workers' compensation, then you are entitled to have your medical bills and a portion of your lost wages covered by the insurer. One aspect of this arrangement is that the employer is shielded from personal injury claims.

Tanker accident in Texas oil field takes 5 workers' lives

The oil and gas boom in Texas has come at a great cost to human life. Accidents continue to happen on drilling sites and the roads that lead to them, and the National Institute for Occupational Safety and Health has reported that the risk of death by transportation accident is significantly higher for oil patch workers than for workers in other kinds of employment. You can read more about these kinds of accidents in our previous post, "Work-related auto accidents up amid Texas fracking boom."

More details emerge around methyl mercaptan leak at DuPont plant

The facts surrounding the fatal chemical leak at a DuPont plant in LaPorte, Texas, continue to surface. As we discussed in a December post, four workers died of asphyxiation when an estimated 23,000 pounds of methyl mercaptan leaked from the plant. Methyl mercaptan is a toxic chemical used to make plastics and insecticides, and to make natural gas smell like rotten eggs.

Report underscores high risk of explosions in oil and gas industry

We've often discussed the high risk of injury associated with work in the oil and gas industry. Companies are required to ensure that rigs and well sites are reasonably safe for workers, but unfortunately one doesn't have to look far to find workers and their families coping with the aftermath of preventable accidents on rigs and platforms.

Bystanders and workers seek $1 billion in damages from BP

Back in October we discussed how work-related fires, explosions and chemical leaks can threaten not only employees and contractors, but also bystanders in the area. In an ongoing lawsuit against BP over a chemical release at a Texas City refinery, the list of more than 500 plaintiffs includes refinery workers and workers at a nearby Dow Chemical plant, as well as residents who live in close proximity to the refinery.

Accurate injury reporting a must for Texas employers

Back in September 2014 we discussed new OSHA regulations that require faster workplace injury reporting from employers. The new rules went into effect on Jan. 1, and employers now must report all work-related eye losses, amputations and hospitalizations to OSHA within 24 hours of the injury.
