Accurate injury reporting a must for Texas employers

Back in September 2014 we discussed new OSHA regulations that require faster workplace injury reporting from employers. The new rules went into effect on Jan. 1, and employers now must report all work-related eye losses, amputations and hospitalizations to OSHA within 24 hours of the injury.

As was the case prior to the changes, employers can be cited for not reporting injuries, injury-related transfers and assignments to lighter duties. Employers should also record an injury or illness if it results in the early termination of a worker's employment. However, that doesn't stop some companies from failing to keep accurate accident logs.

The Houston Chronicle analyzed reports from the Department of Labor and found that since 2007 OSHA has cited at least 110 oilfield employers for failure to maintain accurate logs. This kind of faulty record keeping can affect injured employees' claims for workers' compensation, especially if the injury isn't treated soon after the accident.

If you have been injured on the job, then it is important that you receive medical treatment as soon as possible and that medical records indicate your injury is work-related. Workers' comp claims can be denied when medical records don't show that employment was the cause of an injury or disability. Likewise, a workers' comp claim can be denied for late reporting or if the employer wasn't made aware of the injury.

After a serious work accident, the first thing on your mind should be receiving the treatment you need to get better. Unfortunately, some employers put up obstacles to getting compensation for medical and rehabilitative services.
