OSHA investigates fatal truck equipment accident in Hill County

We recently discussed how heavy work equipment, when defective or not properly maintained, can cause serious injuries on the job site. When defective or poorly maintained equipment is believed to have caused an injurious accident, it is important to identify and notify all potentially liable parties.

Those parties may include the following:

  • The product designer
  • The manufacturer
  • The seller
  • The individual or company responsible for maintaining the equipment
  • The equipment operator
  • The operator's employer

Such questions of liability are likely to arise after a recent accident in Hill County, Texas. The accident happened at a site operated by an energy services company based in The Woodlands.

According to a news report, an employee of the company was performing routine maintenance on the brake system of a commercial truck when the truck's trailer backed over him, causing fatal crushing injuries. Authorities arrived on the scene, and a press release from the local sheriff's department said that it appeared that safety devices on the truck or trailer somehow failed, causing the trailer to back over the employee.

However, the exact cause of the accident remains under investigation, and the employer has reportedly notified OSHA and the other relevant agencies.

Families that lose loved ones to work-related accidents often don't know where to turn for answers. OSHA investigations typically take months to complete, and the results are not always satisfactory to the grieving family. To obtain the full measure of justice, it may be necessary to have a lawyer independently investigate the accident and develop an effective wrongful death claim.
