Payment urged to settle work injury at Dallas-owned dump

It's looking like a waste dump truck driver who got hurt on the job at a Dallas-area dump will be receiving the compensation he has been seeking. A recent item in The Dallas Morning News reports that the city's attorney has asked the City Council to approve a $215,000 payment to Manuel Enriquez.

That' the sum that Enriquez and his attorney are said to have agreed to in order to settle his suit stemming from an October 2012 incident at McCommas Bluff Landfill. According to the suit, Enriquez suffered serious injuries when he was run over by a bulldozer. His claim suggests that the city and the operators of the facility had inadequate safety policies in place to prevent such accidents.

The suit filed in July of last year, says that Enriquez was delivering a load of waste to the landfill and was directed by an employee to take it to a particular area. He was at the site and out of the truck getting ready to make the dump when a landfill bulldozer driving a mass of debris in front of it ran him over.

Court documents say the victim suffered injuries from his neck to his knees. He has had both knees operated on since the accident but is still not able to work because of continued issues.

Another element of the suit made the point that the bulldozer operator, working for the city, failed to exercise reasonable care to avoid injuring Enriquez. It also says the worker who directed the dump truck driver contributed to the negligence by not warning Enriquez of risks or telling the bulldozer driver to be on the alert.

The matter had been headed for trial come this November, but court-ordered mediation led to the two sides to negotiate. In making his recommendation, the city attorney called paying the award would be in the city's best interest.
