Does Texas require employers to carry workers' comp insurance?

No. Texas is the only state in the country that does not require employers to carry workers' compensation insurance, contrary to what many workers believe. That means thousands of workers find themselves on their own after being injured at work, unable to turn to their employers to cover medical bills and/or lost wages.

According to a recent article from HoustonPress, there are also an estimated 1.4 million Texas workers who carry "non-subscription policies," which allow employers to set their own terms for their workers' comp coverage. For example, employers may require workers to report their injuries within 24 hours in order to be covered, while traditional policies give workers up to 30 days to report.

Additionally, HoustonPress reported that, according to the Texas Department of Insurance, half of employers with non-subscription policies offer nothing to the families of workers who are killed on the job.

The secretary-treasurer of the union organization Texas AFL-CIO called Texas' treatment of workers' compensation "absolute corporate control with no oversight or accountability." And injured workers are suffering as a result.
