Child suffers catastrophic injuries in wreck that kills mom

A small boy in Texas is without his mother following a devastating accident involving an 18-wheeler. Suffering from catastrophic injuries, the minor child was the only surviving victim of the accident in which three others were killed. The truck driver believed to have caused the wreck survived with apparent minimal injuries, he is currently facing criminal charges for his role in the accident.

Traffic had slowed behind a vehicle carrying an oversize load and its escort just prior to the wreck. However, an oncoming 18-wheeler driver did not take note of the traffic in front of him. He ultimately crashed into four separate vehicles that had reduced their speeds because of the oversize load.

One witness reported that several people at the scene attempted to help in any way that they could, but there was little that could be done. Two victims died while on the scene, either upon impact or shortly after being struck. Both the child and his mother initially survived, and the child was taken via helicopter to one hospital while the mother was transported in an ambulance to a different medical center. The boy was last listed in critical condition. His mother was later pronounced dead at the hospital.

Texas police have filed one count of intoxicated assault and three of intoxicated manslaughter against the driver of the 18-wheeler, who was apparently under the influence at the time of the wreck. While criminal charges are undoubtedly a wonderful way to achieve a sense of justice for victims who suffered catastrophic injuries and their families, they do not address the wide range of physical, emotional and financial damages experienced after a wreck. Personal injury and wrongful death claims -- both pursued through the civil courts rather than the criminal -- can provide an avenue for victims to successfully achieve compensation their injuries and long-lasting pain and suffering.
