What kinds of problems can spark a motor vehicle defect claim?

In our last post of March, we marked the fact of a recall of thousands of Volvo semi tractors. Not only have those recently made units been recalled for the repair of a piece of their steering mechanisms, but the federal government has also ordered any unrepaired tractors off the road until they do get fixed.

Some might find it unfortunate that a manufacturer with what used to be a solid reputation for safety is in this predicament, but it shouldn't be a surprise to any Texas readers. These tractors are huge, even without a trailer in tow. If a steering malfunction occurs and the tractor goes out of control on the road, anyone on the receiving end of a collision is bound to suffer serious injury or worse.

When there is likelihood that a product defect is to blame for an accident, one of the typical burdens for a plaintiff in a personal injury claim is less of an issue. In an ordinary motor vehicle injury case, a showing of carelessness is often required. But where a product defect is involved, the claim may be based simply on negligence on the part of the manufacturer or a seller.
