Will Oklahoma Supreme Court Ruling Affect Work Injury Claims in Texas?

Up until recently, the only two states that allowed private employers to "opt out" of a state-run workers' compensation system were Texas and Oklahoma.

The Oklahoma Supreme Court recently struck down part of that state's workers' comp law, and now Texas is the only state with an opt-out provision.

Texas labor unions and their attorneys are now considering whether a similar argument can be made to do away with Texas's nonsubscriber option.

Statistics from 2014 show that about 470,000 Texas employees -- or 5 percent -- had no form of workers' comp coverage.

Of the state's 7.7 million private employees, 1.4 million were covered by non-subscribers' alternative plans, which have been widely criticized for giving companies too much control over injured workers' health care decisions and for providing fewer benefits.

Those private non-subscribers include major employers such as Wal-Mart, Costco and Lowe's.

According to the secretary treasurer of the Texas AFL-CIO, the recent ruling in Oklahoma presents an opportunity to try to strike down Texas's opt-out provision in the next legislative session.

However, it remains to be seen whether any change is on the way, as the workers' compensation law in Oklahoma is different than the workers' comp law in Texas.

Texas workers often have to pursue third-party negligence claims to receive full and fair compensation for work injuries.

Left with few options for getting appropriate medical care and putting their lives back on track, injured workers in Texas must pursue every available option for obtaining the compensation they need and deserve.
