Clients should have completed any necessary medical treatment before settling or going to trial.
My clients often ask me when I begin the representation, "How long will it take to finish my case?" And there's not a set answer on that. Every case is different. Primarily, it depends on two factors, first being the client's recovery, how quick they recover from their devastating injuries. Second is the court where there's jurisdiction where the claim is filed. Some courts move faster than others. Some are pretty slow, some are pretty fast. If a client has got ongoing medical treatment, you want to finish the medical treatment before going to trial or attempting settlement so that you know what permanent impairment the client is going to have, whether or not they'll be able to return to work, and what lack of function, if any, they will have.
